1. קבלת התנאים

3. חשבונות משתמש
יצירת חשבון
- עליך לספק מידע מדויק ומלא
- אתה אחראי לשמור על אבטחת החשבון
- עליך להיות לפחות בן 16 כדי להשתמש באפליקציה
- חשבון אחד למשתמש
סוגי חשבונות
- בעל עסק: גישה מלאה להגדרות עסק, ניהול עובדים ושיבוץ משמרות
- מנהל: גישה לשיבוץ משמרות וניהול עובדים (כפי שמאושר על ידי בעל העסק)
- עובד: גישה להגשת זמינות ולצפייה במשמרות מוקצות
4. אחריות המשתמש
אתה מסכים:
- להשתמש באפליקציה בהתאם לחוקים החלים
- לא לשתף את פרטי הכניסה לחשבון שלך
- לא להשתמש באפליקציה למטרות לא מורשות
- לא לנסות לגשת לנתונים של משתמשים אחרים
- לספק מידע עובדים ולוחות זמנים מדויקים
5. התחייבויות בעל העסק
כבעל עסק, אתה מסכים:
- להשיג הסכמה נחוצה מעובדים לשימוש בנתונים שלהם
- לציית לחוקי העבודה והתקנות בתחום השיפוט שלך
- להבטיח מידע עובדים מדויק
- להיות אחראי לכל פעילות תחת חשבון העסק שלך
- לא להשתמש באפליקציה כדי להפר את זכויות העובדים
6. בעלות על נתונים
- הנתונים שלך: אתה שומר על בעלות על כל הנתונים שאתה מזין (מידע עובדים, לוחות זמנים, זמינות)
- רישיון לנו: אתה נותן לנו רישיון להשתמש בנתונים שלך אך ורק כדי לספק את השירות
- נתוני עובדים: בעלי עסקים הם בקרי נתונים עבור מידע העובדים
7. פעילויות אסורות
אסור לך:
- להפר חוקים או תקנות
- להפר זכויות קניין רוחני
- להעלות קוד זדוני או וירוסים
- לנסות לקבל גישה לא מורשית
- להשתמש באפליקציה כדי להטריד או לפגוע באחרים
- לבצע הנדסה הפוכה או להעתיק את האפליקציה
- להשתמש במערכות אוטומטיות כדי לגשת לאפליקציה
8. זמינות שירות
- אנו שואפים ל-99% זמן פעילות אך לא מבטיחים שירות ללא הפרעות
- אנו עשויים לבצע תחזוקה שמגבילה באופן זמני את הגישה
- אנו שומרים לעצמנו את הזכות לשנות או להפסיק תכונות עם הודעה מוקדמת
9. קניין רוחני
- האפליקציה, כולל עיצוב, קוד ותוכן, הם בבעלות שיפטר
- אסור לך להעתיק, לשנות או להפיץ כל חלק מהאפליקציה
- "שיפטר" והלוגואים הקשורים הם הסימנים המסחריים שלנו
10. תשלום ועמלות
- תמחור ותנאי תשלום נוכחיים יסופקו בנפרד
- עמלות אינן ניתנות להחזר אלא אם כן נדרש על פי חוק
- אנו שומרים לעצמנו את הזכות לשנות את התמחור עם הודעה של 30 יום
11. פרטיות
השימוש שלך באפליקציה כפוף למדיניות הפרטיות שלנו, הזמינה באותו מיקום כמו תנאים אלה.
12. סיום
על ידך
- אתה יכול לבטל את החשבון שלך בכל עת דרך הגדרות האפליקציה

אנו עשויים להשעות או לבטל את החשבון שלך אם:

13. הגבלת אחריות
במידה המרבית המותרת על פי חוק:

- אנו לא אחראים לנזקים עקיפים, מקריים או תוצאתיים
- האחריות הכוללת שלנו לא תעלה על הסכום ששילמת ב-12 החודשים האחרונים
- איננו אחראים למחלוקות שיבוץ עובדים או לציות לחוקי העבודה
14. שיפוי
אתה מסכים לשפות ולהגן על שיפטר מכל תביעות הנובעות מ:
- השימוש שלך באפליקציה
- הפרה שלך של תנאים אלה
- הפרה שלך של חוקים או זכויות של צדדים שלישיים
15. יישוב סכסוכים
חוק החל
תנאים אלה כפופים לחוקי מדינת ישראל.

1. Acceptance of Terms
By accessing or using Shifter ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
2. Description of Service
Shifter provides a shift scheduling and workforce management platform for businesses to:
- Manage employee availability
- Create and assign work schedules
- Communicate shift information
- Track employee assignments
3. User Accounts
Account Creation
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You must be at least 16 years old to use the App
- One account per user
Account Types
- Business Owner: Full access to business settings, employee management, and scheduling
- Manager: Access to scheduling and employee management (as authorized by business owner)
- Employee: Access to submit availability and view assigned shifts
4. User Responsibilities
You agree to:
- Use the App in compliance with applicable laws
- Not share your account credentials
- Not use the App for unauthorized purposes
- Not attempt to access other users' data
- Provide accurate employee information and schedules
5. Business Owner Obligations
As a business owner, you agree to:
- Obtain necessary consent from employees to use their data
- Comply with labor laws and regulations in your jurisdiction
- Ensure accurate employee information
- Be responsible for all activity under your business account
- Not use the App to violate employee rights
6. Data Ownership
- Your Data: You retain ownership of all data you input (employee information, schedules, availability)
- License to Us: You grant us a license to use your data solely to provide the service
- Employee Data: Business owners are data controllers for employee information
7. Prohibited Activities
You may not:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Upload malicious code or viruses
- Attempt to gain unauthorized access
- Use the App to harass or harm others
- Reverse engineer or copy the App
- Use automated systems to access the App
8. Service Availability
- We strive for 99% uptime but do not guarantee uninterrupted service
- We may perform maintenance that temporarily limits access
- We reserve the right to modify or discontinue features with notice
9. Intellectual Property
- The App, including design, code, and content, is owned by Shifter
- You may not copy, modify, or distribute any part of the App
- "Shifter" and related logos are our trademarks
10. Payment and Fees
- Current pricing and payment terms will be provided separately
- Fees are non-refundable except as required by law
- We reserve the right to change pricing with 30 days notice
11. Privacy
Your use of the App is subject to our Privacy Policy, available at the same location as these Terms.
12. Termination
By You
- You may terminate your account at any time through the App settings
- Upon termination, you may request data export
By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Fail to pay applicable fees
- Pose a security risk
13. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided "as is" without warranties
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid by you in the last 12 months
- We are not responsible for employee scheduling disputes or labor law compliance
14. Indemnification
You agree to indemnify and hold harmless Shifter from any claims arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any laws or rights of third parties
15. Dispute Resolution
Governing Law
These Terms are governed by the laws of Israel.
Dispute Process
- Contact us first to resolve the issue: nitay@shifter.co.il
- If unresolved, disputes will be handled through arbitration in Israel
- You may have rights under consumer protection laws in your jurisdiction
16. Changes to Terms
We may update these Terms by:
- Posting the updated Terms in the App
- Notifying you via email or in-app notification
- Updating the "Last Updated" date
Continued use after changes constitutes acceptance.
17. Data Export and Portability
You have the right to:
- Export your data in a machine-readable format
- Request a copy of all data associated with your account
- Contact us at nitay@shifter.co.il for data export requests
18. Third-Party Services
The App uses:
- Supabase for database and authentication services
- Third-party services are subject to their own terms and privacy policies
19. Feedback and Suggestions
Any feedback you provide may be used by us without obligation or compensation to you.
